I'm in Boston and I'm jetlagged, so I apologise in advance if this isn't too long. It doesn't really have to be though, because Tim Poulus who always has a couple of moves on me has posted extensively about this, and so has Stefano Quintarelli (for those of you who read Italian).
Basically, the Spanish regulator CMT has announced that they wanted to encourage facilities based competition on FTTH, and so they are offering Telefonica the guarantee that the incumbent will not have to unbundle fiber provided they open their ducts to competitors.
To me this is all kinds of stupid, unless it's all kinds of protective to the guy who needs the least protection, but I will freely admit to not having read everything in detail. Once I'm better, I'll comment further if necessary and even - who knows - change my mind. It has been known to happen!
